ORDER


After making the review required by 28 U.S.C. § 636(b), the Court finds that the Findings, Conclusions and Recommendation of the Magistrate Judge are correct, and they are adopted as the findings and conclusions of the Court.

IT IS THEREFORE ORDERED that Plaintiff's motion for leave to proceed in forma pauperis, filed on January 3, 2005, is DENIED pursuant to the three-strike provision of 28 U.S.C. § 1915(g).

IT IS FURTHER ORDERED that this action will be dismissed as barred by three strikes unless Plaintiff tenders the $150.00 filing fee within 30 days of the District Court's order.

The Clerk shall transmit a copy of this order to Plaintiff.
