This case was calendared for trial at the Court's October 28, 2024, New York City, New York, trial session. On October 7, 2024, respondent filed a Motion to Dismiss for Failure to Properly Prosecute, indicating that petitioner had been noncommunicative. By Order served October 10, 2024, the Court directed petitioner to file a response to respondent's Motion. To date, no such filing by petitioner has been received by the Court.

When this case was called from the calendar on October 28, 2024, petitioner and counsel for respondent appeared and were heard. Petitioner made an oral Motion for Continuance. Upon due consideration and for cause more fully appearing in the transcript of the proceeding, it is

ORDERED that respondent's Motion to Dismiss for Failure to Properly Prosecute, filed October 7, 2024, is taken under advisement. It is further

ORDERED that petitioner's oral Motion for Continuance made on October 28, 2024, is granted. It is further

ORDERED that the parties shall, on or before December 12, 2024, file a signed proposed stipulated decision or a status report (joint or separate) advising as to the then present status of the case. It is further

ORDERED that jurisdiction is retained by the undersigned.
