ORDER

Veronica Rivas-Molloy, Judge

Appellees Highland Village Limited Partnership, Highland Village GP LLC, and Highland Village Holding LLC ("Appellees") filed an Unopposed Motion to Substitute Counsel requesting that Don Jackson, Tyler Henkel, and Simone Dawson of the law firm of Ware, Jackson, Lee, O'Neill, Smith & Barrow, L.P. ("Moving Counsel") be designated as counsel for Appellees in lieu of prior counsel Andrew P. McCormick and Laurie A. Landry Munoz. We construe the Motion as a motion to withdraw and for substitution of counsel.

The Motion does not state that it was "delivered to the party in person or mailed-both by certified and by first-class mail" as required by Rule 6.5(b), (d). We thus deny the Motion without prejudice to refiling. See Tex. R. App. P. 6.5(b), 6.5(d).

It is so ORDERED.
