On October 12, 2023, this Court abated and referred this appeal to mediation. On December 27, 2023, Appellant Humphries Construction Corporation filed a Motion to Reinstate Appeal on the Court's Active Docket and Request for a Briefing Schedule[,]" stating that "[t]he parties participated in a mediation . . . with mediator Clayton Cannon on December 19, 2023[,]" however," [t]he mediation was unsuccessful to resolve the[ir] disputes . . .. Although Appellant failed to include a certificate of conference, more than ten days have passed, and Appellees Highland Village Limited partnership, Highland Village GP LLC, Highland Village Holding LLC, and Trans American Holding Corp. a/k/a Trans American Holdings Corp. n/k/a Trans American Holdings LLC have not expressed opposition to Appellant's Motion. See Tex.R.App.P. 10.3(a).
Appellant's Motion is granted. We hereby lift the abatement and reinstate this case on the Court's active docket.
Appellant's brief is due to be filed forty-five days from the date of this order. See Tex.R.App.P. 38.6(a); (d). Appellees' brief, if any, is due within 20 days of the filing of Appellant's brief. See Tex. R. App. P. 38.6(b). A reply brief, if any, is to be filed within 20 days after the date Appellees' brief is filed. Tex.R.App.P. 38.6(c).
