Nov 18, 1981
405 So. 2d 1079 (Fla. Dist. Ct. App. 1981)

Opinion

No. 81-881.

November 18, 1981.

Appeal from Circuit Court, Pinellas County; Thomas E. Penick, Jr., Judge.

Jerry Hill, Public Defender, and William H. Pasch, Asst. Public Defender, Bartow, for appellant.

Jim Smith, Atty. Gen., Tallahassee, and David T. Weisbrod, Asst. Atty. Gen., Tampa, for appellee.

We affirm the judgment and sentence. However, we remand for clarification of the order relating to the trial judge's statement that he retain jurisdiction for armed robbery, inasmuch he did not state with individual particularity the basis for retaining such jurisdiction as required by section 947.16(3), Florida Statutes (1979).

SCHEB, C.J., and CAMPBELL and SCHOONOVER, JJ., concur.
