Pending before the Court in this case is respondent's Motion to Dismiss for Lack of Prosecution, filed September 30, 2024. On October 1, 2024, the Court served an Order on petitioner requiring him to respond to respondent's motion on or before October 16, 2024. On October 4, 2024, the Court's Chambers Administrator attempted to contact petitioner by telephone regarding respondent's aforementioned motion.
This case was called from the calendar for the Court's standalone remote trial session on October 21, 2024. There was no appearance by or on behalf of petitioner or intervenor. Counsel for respondent appeared and informed the Court that intervenor did not object to the motion to dismiss. To date, the Court has received no response from petitioner to either its Order or the telephone call. Upon due consideration, and for cause more fully appearing in the transcript of the proceedings, it is
ORDERED that the time within which petitioner shall respond to respondent's Motion to Dismiss for Lack of Prosecution, filed September 30, 2024, is extended to December 9, 2024. It is further
ORDERED that, should intervenor wish to respond to respondent's aforementioned motion, she should file a response on or before December 9, 2024.
Petitioner is advised that failure to respond to the Court's Order may result in the granting of respondent's Motion to Dismiss for Lack of Prosecution, and a decision being entered against petitioner in accordance with that motion.
