Interlocutory judgment reversed, with costs, and demurrer sustained, with costs, with leave to the plaintiff to plead over on payment of costs within twenty days, on the authority of Hughes v. New York Evening Post Co. ( 115 App. Div. 611). Hirschberg, P.J., Hooker, Gaynor, Rich and Miller, JJ., concurred.
