Judgment affirmed, with costs. No opinion. Young, Hagarty, Seeger and Carswell, JJ., concur; Lazansky, P.J., dissents, being of opinion that there was no stress of circumstances that distinguishes the case from Rohrbacher v. Gillig ( 203 N.Y. 413).
