ORDERED that the motion is denied, without costs, as unnecessary (see 22 NYCRR 1250.10 [a]). It is noted that the dismissal pursuant to 22 NYCRR 1250.10 (a) is without prejudice to a motion to vacate pursuant to 22 NYCRR 1250.10 (c).
