Gabriela HOYOS, Appellant v. Massoud FAGGHI, Appellee

From the County Court at Law No. 3, Bexar County, Texas Trial Court No. 2024CV00434 Honorable Cesar Garcia, Judge Presiding

REBECA C. MARTINEZ CHIEF JUSTICE, LUZ ELENA D. CHAPA, IRENE RIOS, BETH WATKINS, LIZA A. RODRIGUEZ, LORI I. VALENZUELA, LORI MASSEY BRISSETTE JUSTICES

ORDER

Liza A. Rodriguez, Justice

The court reporter responsible for filing the reporter's record in this appeal has filed a notification of late record, stating that the reporter's record has not been filed because appellant, Gabriela Hoyos, failed to serve her with a copy of the notice appeal in accordance with section 51.017(a) of the Texas Civil Practice and Remedies Code. See Tex. Civ. Prac. & Rem. Code § 51.017(a). Accordingly, we ORDER appellant to file an amended notice of appeal that complies with section 51.017(a) on or before July 26, 2024.

Additionally, we note that appellant must request in writing that the court reporter prepare the reporter's record and must designate the exhibits and the portions of the proceedings to be included in the reporter's record. See Tex. R. App. P. 34.6(b)(1) (explaining that the request to the court reporter must designate the exhibits and the portions of the proceedings to be included in the reporter's record). Accordingly, we ORDER appellant to file, on or before July 26, 2024, a notice in this court showing that she has asked the official court reporter to prepare the reporter's record and designated the exhibits and the portions of the proceedings to be included. If appellant fails to comply within the time provided, appellant's brief will be due within thirty days from the date of this order, and the court will only consider those issues or points raised in appellant's brief that do not require a reporter's record for a decision. See Tex. R. App. P. 37.3(c).

Finally, we note that appellant has not filed the required docketing statement. See Tex. R. App. P. 32.1. We, therefore, ORDER appellant to file her docketing statement in this court on or before July 26, 2024.
