On August 29, 2023, the Court entered an Order of Dismissal for Lack of Jurisdiction in this case on the ground that petitioner had failed to file a proper amended petition.
On September 25, 2023, the following documents were electronically filed on petitioner's behalf: (1) a Limited Entry of Appearance for Petitioner Brian Howell by Luciana C. Petry, and (2) a First Amended Petition. Because Ms. Petry signed and filed the First Amended Petition, the Court's records in this case currently reflect that she has entered an appearance for petitioner. However, the Limited Entry of Appearance indicates that petitioner and Ms. Petry have agreed that her representation in this case will be limited to the filing of the First Amended Petition on petitioner's behalf.
In consideration of the foregoing, it is
ORDERED that the Court's Order of Dismissal for Lack of Jurisdiction in this case is vacated and set aside. It is further
ORDERED that Luciana C. Petry's Limited Entry of Appearance for Petitioner Brian Howell is recharacterized as a Motion to Withdraw as Counsel. It is further
ORDERED that Luciana C. Petry's Motion to Withdraw as Counsel is granted, and Ms. Petry is withdrawn as counsel for petitioner in this case. It is further
ORDERED that, in addition to regular service, the Clerk of the Court shall serve a copy of this Order on petitioner Brian Howell.
