STACEY D. HOWARD, Appellant v. JACK V. LOWERY, ET AL., Appellees
On Appeal from the 401st Judicial District Court Collin County, Texas
Trial Court Cause No. 401-04354-2013
ORDER
The clerk's record is overdue. By order dated March 16, 2016, the Court granted appellant's motion for a ninety-day extension of time to file the clerk's record. By order dated July 18, 2016, the Court, on its own motion, ordered appellant to provide, by August 15, 2016, written verification that he had paid the clerk's fee. Rather than provide the requested written verification, appellant filed further extension motions on August 5th and August 9th, seeking an additional sixty days to pay for the clerk's record. We GRANT appellants' motions to the extent that appellant shall provide, by OCTOBER 4, 2016, written verification that he has paid the district clerk's fee for preparation of the clerk's record. We caution appellant that failure to provide the requested written verification by October 4, 2016 may result in dismissal of the appeal without further notice. See TEX. R. APP. P. 37.3(b).
We DENY as moot appellant's July 19, 2016 "Motion Requesting the Court to Rule on His Previous Motion for Filing Late Clerk's Records or Extension of Time to File for an Affidavit of Indigence Under the Rules."
