JUDGMENT


In accordance with the Order entered this date, it is ORDERED, ADJUDGED, and DECREED that plaintiffs' Motion to Remand be and is hereby GRANTED. The Clerk shall REMAND this action to the Circuit Court of Mobile County, Alabama. Defendant Commercial Federal Mortgage Corporation to pay costs.

ORDER ADOPTING THE REPORT AND RECOMMENDATION OF THE MAGISTRATE JUDGE

After due and proper consideration of all relevant pleadings in this file, and there having been no objections filed, the Recommendation of the Magistrate Judge made under 28 U.S.C. § 636(b)(1)(b), and dated January 25, 2001, is hereby ADOPTED as the opinion of this court.

Accordingly, it is ORDERED that plaintiffs' Motion to Remand be and is hereby GRANTED.

This case is hereby REMANDED to the Circuit Court of Mobile County, Alabama. The Clerk is DIRECTED to take all steps necessary to effectuate the remand. Costs are assessed against defendant Commercial Federal Mortgage Corporation.
