Houston International Management & Trade, Inc. v. Peacock Shipping and Trading Inc., Celestial Holdings Ltd., Celestial Company, and Marios Giakoumakos

Trial court: 151st District Court of Harris County, Trial court case number: 2018-70719

ORDER

David Gunn, Judge

The appellate record in this appeal was originally due on August 21, 2024. The trial court clerk filed the clerk's record on October 10, 2024. On July 25, 2024, the court reporter for the 151st District Court of Harris County filed an "Information Sheet by Court Reporters," notifying the Court that appellant had not paid, or made arrangements to pay, the fee for the preparation of the reporter's record.

On August 28, 2024, the court reporter requested that the deadline for filing the reporter's record be extended to September 26, 2024. In her request the court reporter stated that appellant had paid half of the cost for the preparation of the reporter's record. The Court granted the request, extending the deadline to file the reporter's record to September 27, 2024. See Tex. R. App. P. 35.3(c) (appellate court may extend deadline for filing record on request by reporter, with any extension not exceeding thirty days).

On October 1, 2024, the court reporter filed a second request for extension of the deadline to file the reporter's record. The second request for extension was granted by the Court, extending the deadline for filing the reporter's record to October 28, 2024.

On October 28, 2024, the court reporter filed a third request for extension of time to file the reporter's record, requesting the deadline be extended to November 8, 2024. The court reporter's request for an extension states that she needs "a couple of weeks to finalize the record and receive the balance due from [a]ppellant."

The court reporter's third request for an extension is granted. The reporter's record is due no later than November 8, 2024. See Tex. R. App. P. 35.3(c) (appellate court may extend deadline for filing record on request by reporter, with any extension not exceeding thirty days). Additionally, the court reporter is notified that no further extensions will be granted absent extraordinary circumstances, and the failure to file the reporter's record by November 8, 2024 may result in the appeal being abated and remanded to the trial court for a hearing to determine the reason for the failure to timely file the reporter's record. See Tex. R. App. P. 35.3(c) (requiring courts to ensure that appellate record is timely filed).

It is so ORDERED.
