ORDER OF DISMISSAL AND DECISION

On March 30, 2023, respondent filed a Motion to Dismiss for Lack of Prosecution.

This case was called from the calendar of the Court's May 30, 2023 Tampa, Florida trial session. There was no appearance by or on behalf of the petitioner. Counsel for respondent appeared and was heard on the Motion to Dismiss. After due consideration and for cause more fully appearing in the transcript of the proceeding, it is

ORDERED that respondent's Motion to Dismiss for Lack of Prosecution, filed March 30, 2023, is granted, and this case is dismissed for lack of prosecution. It is further

ORDERED and DECIDED that there is a deficiency in income tax due from petitioner in the amount of $4,646 for the taxable year 2019, as set forth in the statutory notice dated October 25, 2021.
