ORDER ADOPTING REPORT AND RECOMMENDATION


The Court has before it a Report and Recommendation filed by the United States Magistrate Judge, The Honorable Mikel H. Williams. Plaintiff has objected to the Report, and defendant has responded to plaintiffs objection. The Court has examined the Report pursuant to 28 U.S.C. § 636 (b)(1) and finds that it clearly and accurately sets forth the facts and correctly applies the governing legal standards.

Accordingly,

NOW THEREFORE IT IS HEREBY ORDERED, that the Report and Recommendation (Docket No. 36) shall be, and the same is hereby, ADOPTED as the decision of the District Court and incorporated fully herein by reference.

IT IS FURTHER ORDERED, that defendant's Motion to Dismiss (Docket No. 11) is hereby GRANTED, and that plaintiff's Motion to Remand Case Back to State Jurisdiction (Docket No. 7) is hereby DENIED.
