MEMORANDUM OPINION

PER CURIAM.

After submission, the Court abated this appeal on February 28, 2002 due to bankruptcy of one of the parties. On March 1, 2004, appellant filed a motion to reinstate appeal and reverse and render judgment. The certificate of conference states that appellee opposes the motion. On March 5, 2004, the court requested appellee to file a response to the motion within ten days of the date of the letter. To date, appellee has not filed a response. The Court GRANTS the motion in part and REINSTATES this appeal. Without consideration of the merits, the Court DISMISSES the appeal as moot due to the effect of approval of a reorganization plan by the bankruptcy court. Tex.R.App.P. 42.1.
