This case was initially set for trial on April 15, 2023, petitioners failed to appear at the calendar call. On April 17, 2023, respondent made an Oral Motion to Dismiss for Lack of Prosecution (index #18). The Court took this motion under advisement and issued petitioner an Order to Show Cause on May 3, 2023. On August 2, 2023, the Court set respondent's oral motion for hearing at the Court's September 25, 2023, San Francisco, California trial session. On September 25, 2023, this case was called. There was no appearance by or anyone on behalf of petitioners. Counsel for respondent appeared and was heard.
At that time respondent informed the Court that a basis for settlement had been reached with petitioner Colleen Hooks and that a Stipulation of Settlement as well as a Stipulated Decision have been signed by her. Respondent is just waiting to receive the original signed documents. Also, respondent renewed his Oral Motion to Dismiss for Lack of Prosecution as to petitioner Dane Rawson Hooks.
Upon due consideration and for cause more fully appearing in the transcript, it is hereby
ORDERED that respondent's Oral Motion to Dismiss for Lack of Prosecution is taken under advisement. It is further
ORDERED that, on or before October 25, 2023, the parties shall submit to the Court either a stipulated decision or file a status report (joint or separate) regarding the then-present status of this case.
