An appeal having been taken to this Court from an order of the Supreme Court, New York County, entered on or about December 29, 2020, and said appeal having been perfected, And plaintiffs-respondents having moved to dismiss the aforesaid appeal on the ground that nonparty-appellants' appendix does not contain any of the exhibits submitted by plaintiffs-respondents to the trial court or, in the alternative, to direct non-party-appellants to file a new appendix which includes the items set forth in the chart annexed as Exhibit D to the Affirmation of Joseph Aronauer, Esq., submitted with the instant motion, and for an extension of time to file a respondents' brief, Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon,

It is ordered that the motion is granted to the extent that nonparty-appellants are directed to file a supplemental appendix, for the March 2022 Term of this Court, which shall include the exhibits plaintiffs submitted to the trial Court, as set forth in Exhibit D to the Aronauer Affirmation. The perfected appeal is hereby adjourned to the March 2022 Term of this Court.
