ORDER


On April 27, 2007, this Court issued a majority and a dissenting opinion in this case. See Holt v. Sakowitz Inc., No. 01-05-01194-CV, 2007 WL 1299680 (Tex.App.-Houston [1st Dist.] April 27, 2007, no pet. h.). The Court sua sponte withdraws its April 27, 2007 majority and dissenting opinions and judgment. See TEX. R. APP. P. 19.1. The cause remains pending before the Court. The motion for rehearing filed by appellee, Cedyco Corporation, assignee of Sakowitz, Inc., is dismissed as moot.
