Action to recover damages for personal injuries. On argument, order denying defendant's motion to place the action on the Military Suspense Calendar or for other relief reversed on the facts without costs and the motion granted to the extent of permitting defendant to take the testimony of Doctors Jennings, Cali, Meyers, Margolis and Robbins by interrogatories and cross-interrogatories to be agreed upon between the respective attorneys for plaintiff and defendant, the said interrogatories and cross-interrogatories to be returned on or before February 23, 1943. Subject to the approval of the justice presiding, the trial of the action is directed to proceed on February 23, 1943. Close, P.J., Hagarty, Johnston, Adel and Lewis, JJ., concur.
