Hollywood v. Colling

Appellate Division of the Supreme Court of New York, Second Department
Oct 1, 1910
140 App. Div. 893 (N.Y. App. Div. 1910)

Opinion

October, 1910.

Judgment of the Municipal Court reversed and new trial ordered, costs to abide the event, on the ground that while the plaintiff was entitled to recover against the defendant for use and occupation of the premises, there was also sufficient evidence of the value of the cash register to make a prima facie case in support of the counterclaim. Woodward, Jenks, Burr, Thomas and Carr, JJ., concurred.
