AMENDED ORDER AFFIRMING REPORT RECOMMENDATION
This matter is before the court on Plaintiff Donald Holbrook's petition to reverse the final agency decision regarding his applications for Disability Insurance Benefits and Supplemental Security Income under Title II of the Social Security Act, 42 U.S.C. § 401-434.
This case was assigned to United States District Court Judge Dale A. Kimball, who then referred it to United States Magistrate Judge Samuel Alba under 28 U.S.C. § 636(b)(1)(B). On October 31, 2003, Magistrate Judge Alba issued a Report and Recommendation, recommending that the Commissioner's decision denying benefits be reversed and remanded for the Commissioner for proper consideration of the reports of Plaintiff s treating physicians. No objection has been filed to the Report and Recommendation.
The court has reviewed the file de novo. The court approves and adopts the Magistrate Judge's Report and Recommendation in its entirety. Accordingly, the Commissioner's decision denying benefits is REVERSED and the matter is REMANDED, pursuant to sentence four of 42 U.S.C. § 405(g), to the Commission for further proceeding consistent with this order. Therefore, this case is CLOSED.
