This case is calendared for a remote trial at the session of the Court scheduled to commence at 10:00 a.m. on May 1, 2023, for cases in which Syracuse, New York, is the place of trial. On April 11, 2023, respondent filed a motion to dismiss for failure to properly prosecute.

Upon due consideration and for cause, it is

ORDERED that the above-referenced motion is set for remote hearing during the Court's May 1, 2023, Syracuse, New York, remote trial session at 10:00 a.m. on Monday, May 1, 2023. Petitioner is advised that failure to participate in the remote hearing on May 1, 2023, may result in the Court granting respondent's motion and entering an order and decision against petitioner.
