On November 13, 2023, after the supreme court remanded this cause to us, we ordered the parties to file amended briefs to address the analytical framework introduced in Van Dyke v. Navigator Group, 668 S.W.3d 353 (Tex. 2023). A principal purpose for the additional briefing is to allow the parties to develop and present their arguments to this court. See Thomson v. Hoffman, 674 S.W.3d 927, 929 (Tex. 2023).
After Appellees filed their amended brief, Appellants moved for additional time to file a reply brief. See Tex. R. App. P. 38.3.
In their response to Appellants' motion, Appellees objected to allowing Appellants to file an additional brief without Appellees having the same opportunity.
Appellants' motion is GRANTED. Appellants' reply brief is due on July 8, 2024.
Appellees may file their response to Appellants' reply brief within TWENTY DAYS after Appellants' reply brief is filed. See Tex. R. App. P. 38.6(c).
