MICHAEL ALAN HODGES, Appellant v. THE STATE OF TEXAS, Appellee

On Appeal from the 54th District Court McLennan County, Texas
Trial Court No. 2014-1486-C2 Before Morriss, C.J., Moseley and Burgess, JJ. ORDER

Michael Alan Hodges was convicted of two counts of aggravated assault. He appeals from the judgments memorializing those convictions and the resulting sentences. The clerk's record and the reporter's record in this matter were filed April 29, 2016, making Hodges' appellate brief originally due May 29, 2016. That deadline was extended three times by this Court, resulting in the most recent due date of August 1, 2016. Hodges has now filed a fourth motion seeking an additional seven-day extension of the briefing deadline until August 2.

While it is not typically our practice, this Court conditionally granted Hodges' motion in the circumstance his appellate brief was filed on August 2. Hodges has yet to file his appellate brief. Consequently, we overrule his fourth motion to extend time to file his appellate brief.

We order that Hodges' appellate brief be filed with this Court on or before August 12, 2016.

IT IS SO ORDERED.
