Supreme Court of Florida
Jan 4, 1963
148 So. 2d 272 (Fla. 1963)

Opinion

No. 32172.

January 4, 1963.

Case of original jurisdiction — Habeas Corpus.

Howard DeWayne Hodge, in pro. per.

Richard W. Ervin, Atty. Gen., and George R. Georgieff, Asst. Atty. Gen., for respondent.

This cause coming on for further consideration upon the writ of habeas corpus heretofore issued, and the return of the respondent, and the court having considered the same, it now appears that the writ was improvidently issued. Accordingly, the writ of habeas corpus is discharged and the petitioner remanded to the custody of the respondent.

It is so ordered.

ROBERTS, C.J., and TERRELL, THOMAS, DREW and THORNAL, JJ., concur.
