In an action to recover damages for wrongful death, defendant trustee in bankruptcy of a railway company appeals from so much of an order as directs the examination of the defendant before trial by the railway company's fireman. Order, insofar as appealed from, affirmed, with ten dollars costs and disbursements, the examination to proceed on five days' notice. No opinion. Close, P.J., Carswell, Johnston, Adel and Taylor, JJ., concur.
