Appeal by Bank of America, as successor in interest to Countrywide Home Loans Servicing, LP, from an order of the Supreme Court, Kings County, dated May 7, 2012. The appeal was perfected on December 20, 2012. By order dated November 26, 2012, the Supreme Court, Kings County, granted the motion of Bank of America to dismiss the complaint insofar as asserted against it.

Now, on the Court's own motion, it is

ORDERED that the appellant is directed to show cause before this Court why an order should or should not be entered dismissing the appeal on the ground that it has been rendered academic by filing an affirmation or affidavit on that issue with the Clerk of this Court on or before May 2, 2012; and it is further,

ORDERED that the Clerk of this Court, or her designee, is directed to serve a copy of this order to show cause on the parties or their attorneys by regular mail.
