Peter J. Panuthos Special Trial Judge

By Notice dated September 9, 2021, this case is calendared for trial on the Court's Dallas, Texas trial calendar commencing on January 24, 2022 (to be conducted remotely). On December 21, 2021 respondent's counsel filed a Motion For Continuance. In his motion respondent asserts that petitioners do not object to the granting of the motion. The Court will grant the motion.

The Court notes that a review of the Certificate of Service attached to the motion indicates that service was not made on petitioner Wesley K. Hix at his address of record and the Court will direct the Clerk of the Court to serve on petitioner a copy of respondent's motion.

Premises considered, it is

ORDERED that respondent's Motion For Continuance, filed December 21, 2021 is granted and this case is stricken for trial from the Court's January 24, 2022 remote Dallas, Texas trial session and is continued generally. It is further

ORDERED that the Clerk of the Court shall, in addition to regular service, serve a copy of respondent's motion on petitioner Wesley K. Hix at his address of record.

This Order constitutes official notice of the same to the parties.
