DECISION & ORDER ON MOTION

Proceeding pursuant to CPLR article 78, inter alia, in the nature of mandamus to compel the respondent Karen Rothenberg, a Justice of the Supreme Court, Kings County, to provide the petitioner with free transcripts in an action entitled Hirsch v Wahba, pending in that court under Index No. 514979/2021, and application by the petitioner for poor person relief.

Upon the papers filed in support of the application and the papers filed in opposition thereto, it is

ORDERED that the application for poor person relief is denied; and it is further, ORDERED that on the Court's own motion, in the event that the filing fee has not been paid within 120 days from the date of this decision and order on motion, the proceeding shall be dismissed (see CPLR 1101[d]; 8022[b]; 22 NYCRR 1250.17[a][1]).
