Hirsch v. Moss

Appellate Division of the Supreme Court of New York, First Department
Nov 1, 1916
175 App. Div. 917 (N.Y. App. Div. 1916)

Opinion

November, 1916.

Present — Clarke, P.J., Laughlin, Dowling, Smith and Davis, JJ.

We are of opinion that the finding of the jury that the purchase of the Cerro de Pasco Copper Company stock was not ordered by the defendant is against the weight of the evidence. The judgment and order appealed from are, therefore, reversed and a new trial ordered, with costs to appellant to abide the event.

Judgment and order reversed, new trial ordered, costs to appellant to abide event.
