Opinion

No. 28,151.

Filed January 15, 1946.

MANDAMUS — Grounds — Compelling Action on Petition For Writ of Error Coram Nobis — Cause Not Pending Before Respondent Judge — Dismissal. — Where, in an original action for a writ of mandate to compel a judge to hear a petition for writ of error coram nobis, the response showed that the cause was not pending before the respondent judge, but before the judge who presided in the trial of the case at the time of relator's conviction, the petition was dismissed.

Original action by Paul Edward Hinton against Nat H. Youngblood, Judge of the Vanderburgh Circuit Court, to compel respondent to hear a petition for writ of error coram nobis. Petition Dismissed.

Paul Edward Hinton, pro se.

Nat H. Youngblood, pro se.

Relator seeks a writ of mandate to compel respondent to hear a petition for writ of error coram nobis. The response shows that the cause is not pending before respondent but before the judge who presided in the trial of the case at the time of relator's conviction. Accordingly the petition is dismissed.
