Hillsborough County H W Board v. Overstreet

Supreme Court of Florida
Dec 3, 1968
216 So. 2d 199 (Fla. 1968)

Opinion

No. 37902.

December 3, 1968.

Writ of Certiorari to the Florida Industrial Commission.

Ronald D. McCall, of Fowler, White, Collins, Gillen, Humkey Trenam, Tampa, for petitioners.

John A. Williamson of Barrs Williamson, Tampa, Patrick H. Mears and J. Franklin Garner, Tallahassee, for respondents.

By petition for a writ of certiorari we have for review an order of the Florida Industrial Commission bearing date September 13, 1968.

We find that oral argument would serve no useful purpose and it is therefore dispensed with pursuant to Florida Appellate Rule 3.10, subd. e, 32 F.S.A.

Our consideration of the petition, the record and briefs leads us to conclude that there has been no deviation from the essential requirements of law.

The petition is therefore denied.

The petition for attorney's fees filed by Respondent Overstreet is granted in the amount of $250.00.

It is so ordered.

CALDWELL, C.J., and ROBERTS, DREW, ERVIN and HOPPING, JJ., concur.
