Judgment and order of the County Court of Queens county reversed and new trial ordered, costs to abide the event, upon the ground that Philpot was not plaintiff's superintendent, and that he was not constrained to act under his orders. Jenks, P.J., Hirschberg, Thomas, Carr and Rich, JJ., concurred.
