ORDER GRANTING GUARDIAN AD LITEM'S PETITION TO SUBORDINATE THE SECOND DEED OF TRUST HELD BY THE PRIVATE TRUST TO A THIRD DEED OF TRUST SUBMITTED UNDER ORDER TO SEAL CONFIDENTIAL DOCUMENTS DATED MARCH 3, 2008, AT DOCUMENT NO. 478


This Court, having read and carefully considered the representations of both the Guardian Ad Litem and those set forth in the letter dated September 4, 2009 from Regions Bank to Charles Goldberg, FINDS AND ORDERS:

1. The terms and conditions of the proposed refinancing secured by the residence owned by Robert and Audrey Hill and occupied by Tasha R. Hill and her parents in Celina, TN will not materially and adversely affect the assets of the amended Private Trust for the Benefit of Tasha R. Hill ("Private Trust").

2. The proposed refinancing is in the best interests of Tasha R. Hill, her parents, Robert and Audrey Hill, and the Private Trust.

Accordingly,

IT IS THEREFORE ORDERED that the said Petition to subordinate the Deed of Trust owned by the Private Trust from a Second Deed of Trust to a Third Deed of Trust (Doc 574) is GRANTED. Upon completion of the refinancing outlined in the Petition, Regions Bank is authorized to execute any and all documents necessary to effectuate a subordination of the Private Trust's Deed of Trust securing its $200,000.00 loan to Robert Hill to the First and Second Deeds of Trust to be executed in connection with the proposed refinancing.
