Hill v. State

District Court of Appeal of Florida, Fourth District
Oct 11, 1989
549 So. 2d 821 (Fla. Dist. Ct. App. 1989)

Opinion

Nos. 88-2304, 88-3114.

October 11, 1989.

Consolidated appeals from the Circuit Court for Broward County; Lawrence L. Korda, Judge.

Richard L. Jorandby, Public Defender, and Tanja Ostapoff, Asst. Public Defender, West Palm Beach, for appellant.

Robert A. Butterworth, Atty. Gen., Tallahassee, and Pamela D. Cichon, Asst. Atty. Gen., Daytona Beach, for appellee.

We reverse and remand with directions that an evidentiary hearing be conducted on appellant's motion for relief from his conviction and sentence. We decline to rule on the substantive issues raised by appellant because we believe all those issues must first be raised and decided by the trial court after the evidentiary hearing.

ANSTEAD, GLICKSTEIN and WARNER, JJ., concur.
