In Re: State of Louisiana through the Division of Administration, Office of Contractual Review, Kristy Nichols, in her official Capacity as Commissioner of Administration, and Pamela Bartfay Rice, in her official capacity as Interim Director of the Office of Contractual Review, applying for supervisory writs, 19th Judicial District Court, Parish of East Baton Rouge, No. 632170.
BEFORE: GUIDRY, THERIOT AND DRAKE, JJ.
WRIT NOT CONSIDERED. Relators have failed to comply with Rule 4-2 and 4-3 Uniform Rules of Louisiana Courts of Appeal, in that the notice of intent and return date order contained in the writ application do not appear to have been filed within thirty (30) days of the trial court's ruling on defendants' exceptions as to the Board of Elementary and Secondary's (BESE's) petition for intervention. The hearing was held on August 18, 2014, with the trial court denying defendants' exceptions in open court. Because this Court was only provided with an excerpt of the transcript of the hearing, this Court is unable to discern from review of the transcript whether the trial court ordered the interlocutory ruling be reduced to writing or whether he indicated he was taking that particular matter under advisement.
Supplementation of this writ application and/or an application for rehearing will not be considered. Rules 4-9 and 2-18.7, Uniform Rules of Louisiana Courts of Appeal.
In the event relators seek to file a new application with this Court, it must contain all pertinent documentation and must comply with Rules 2-12.2, Uniform Rules of Louisiana Courts of Appeal. Any new application must be filed on or before December 1, 2014, and must contain a copy of this ruling.
