JUDGMENT


In accordance with the Order entered this date, it is hereby ORDERED that the decision of the Commissioner of Social Security denying claimant benefits be reversed and this cause remanded to the Commissioner pursuant to sentence four of 42 U.S.C. § 405(g) for further proceedings.

The remand pursuant to sentence four of § 405(g) makes the Plaintiff a prevailing party under the Equal Access to Justice Act, 28 U.S.C. § 2412, Shalala v. Schaefer, 509 U.S. 292 (1993), and terminates this Court's jurisdiction over this action.

ORDER

After due and proper consideration of all pleadings in this file, and there having been no objections filed, the Recommendation of the Magistrate Judge made under 28 U.S.C. § 636(b)(1)(B) is adopted as the opinion of this Court.

It is ORDERED that this action be REVERSED and REMANDED to the Social Security Administration for further administrative proceedings.
