Opinion
Civil Action No. 3:02-CV-419-L
November 5, 2002
ORDER
Before the court is Petitioner Raymond Bruce Hill's ("Petitioner") Motion for Copies of Proceedings and All Supporting Documents and Evidence, filed June 12, 2002; Motion for Certificate of Probable Cause, filed June 14, 2002; and Motion for Appointment of Counsel, file June 14, 2002. After a review of the motions and the record in this case, the court denies as moot Petitioner's Motion for Copies of Proceedings and All Supporting Documents and Evidence; Motion for Certificate of Probable Cause; and Motion for Appointment of Counsel.
It is clear from the documents filed that Petitioner filed these motions for purposes of appeal. The court denied with prejudice Petitioner's Writ of Habeas Corpus in its order and judgment dated May 30, 2002. On June 13, 2002, Petitioner filed a notice of appeal, and the court, on June 26, 2002, denied Petitioner's Certificate of Appealability. Thereafter, on October 9, 2002, the Fifth Circuit also denied Petitioner's Certificate of Appealability. The court therefore denies as moot Petitioner's Motion for Copies of Proceedings and All Supporting Documents and Evidence; Motion for Certificate of Probable Cause; and Motion for Appointment of Counsel.
