Opinion

No. 93-3408.

March 17, 1995.

An appeal from Order of Judge of Compensation Claims; Joseph Murphy, Judge.

David J. Lonigro of Haas, Austin, Ley, Roe Patsko, P.A., Tampa, for appellants.

C. Brad Drummond and Peter D. Weinstein of O'Brien Hooper, P.A., Tampa, for appellee.

In this workers' compensation case the claimant concedes that penalties should not have been awarded, and we therefore strike this provision from the challenged order. As amended, the order is affirmed.

ALLEN and DAVIS, JJ., and WENTWORTH, Senior Judge, concur.
