On order of the Court, the motion for immediate consideration is considered, and it is GRANTED. The application for leave to appeal from the September 7, 1999, decision of the Court of Appeals is considered, and it is DENIED, because we are not persuaded that the questions presented should be reviewed by this Court. The application for leave to appeal as cross-appellant and the motion to consolidate this case with James v Alberts (Docket No. 114454) are moot and are therefore DENIED.
