ORDER

Appellee and Cross-Appellant, Pedro A. Quiñones, has filed a motion to strike part of the clerk's record and a request pursuant to Texas Rule of Appellate Procedure 34.5(b)(3) to require appellant to pay the cost for the preparation of the unnecessary portion of the record.

The motion to strike part of the clerk's record is denied. The motion to assess costs is denied without prejudice to refiling the request after briefing is complete. Any further request must show the portion of the record alleged to be unnecessary and the cost associated with its preparation.
