MEMORANDUM OPINION ON REHEARING


By opinion dated October 22, 2003, we dismissed this appeal for failure to pay the filing fee. Hilal v. Cowee, No. 12-03-00296-CV, 2003 WL 22411230 (Tex. App. Tyler October 22, 2003, no pet.) (not designated for publication). On November 17, 2003, Appellant's attorney paid the filing fee. At the same time, Appellant's attorney filed a motion to reinstate, which we construe as a motion for rehearing, in which he alleged facts that we consider sufficient to show good cause for failure to pay the filing fee. We gave Appellee's counsel an opportunity to respond to Appellant's motion, but did not receive a response. Consequently, Appellant's motion for rehearing is granted, and this appeal is reinstated.
