Serge L. HIDEN, Appellant v. The STATE of Texas, Appellee
From the 379th Judicial District Court, Bexar County, Texas
Trial Court No. 2017CR10973
Honorable Dick Alcala, Judge Presiding
ORDER
The appellant's brief was originally due to be filed on March 4, 2019. The appellant's first motion for extension of time was granted, extending the deadline for filing the brief to April 3, 2019. On April 3, 2019, appellant filed a second motion for extension of time. By order dated April 9, 2019, the motion was granted, extending the deadline for filing the brief to May 3, 2019. The order stated," THIS IS THE FINAL EXTENSION OF TIME THAT THE APPELLANT WILL BE GRANTED ."
On May 6, 2019, appellant filed a third motion for extension of time requesting an additional thirty days to file the brief. In the motion, appellant's counsel stated he was unable to view a copy of an exhibit. Although the exhibit could have been accessed through the copy contained in the appellate record, the motion is GRANTED. The appellant's brief must be filed no later than June 3, 2019. NO FURTHER EXTENSIONS OF TIME WILL BE GRANTED . See TEX. R. APP. P. 38.8(b)(4) (appellate court must "act appropriately to ensure that the appellant's rights are protected" when the appellant's brief is not timely filed).
