The petition for writ of mandamus is hereby granted. The Fifth District Court of Appeal shall reinstate petitioner's appeal in Case No. 5D04-1041. Because the Court trusts that the Fifth District Court of Appeal will fully comply with the dictates of this order, we withhold issuance of the writ. Petitioner's "Motion to Compel Answer to Interrogatories" is hereby denied.
