ORDER


A hearing on motions and scheduling was held by telephone in this case on December 28, 2004, before United States District Judge Barbara B. Crabb. Plaintiff was represented by John Allcock, Andrew Valentine and Allen Arntsen. Defendant was represented by Bryan Farney, Sarah Adams and Michael Modl.

I granted plaintiff's motion for leave to file a second amended complaint. The second amended complaint is deemed filed and served as of today.

Because the filing of the second amended complaint changes the contours of the lawsuit to some extent, the previous briefing schedule set on defendant's motion to dismiss is amended as follows: The brief in support of the motion to dismiss is to be served and filed no later than January 11, 2005. Plaintiff's brief in opposition to the motion is to be served and filed no later than January 17, 2005.
