Hester v. State

District Court of Appeal of Florida, Second District
Mar 10, 1999
730 So. 2d 747 (Fla. Dist. Ct. App. 1999)

Opinion

No. 97-04426

Opinion filed March 10, 1999

Appeal from the Circuit Court for Pinellas County; Anthony Rondolino, Judge.

James Marion Moorman, Public Defender, Bartow, and Allyn Giambalvo, Assistant Public Defender, Clearwater, for Appellant.

Robert A. Butterworth, Attorney General, Tallahassee, and Dale E. Tarpley, Assistant Attorney General, Tampa, for Appellee.

Craig Hester appeals the trial court's denial of credit for time at liberty following his premature release. Because Hester's premature release cannot be attributed to "fault" on Hester's part, we reverse. See Carson v. State, 489 So.2d 1236 (Fla. 2d DCA 1986).

Reversed and remanded.

PATTERSON, A.C.J., and WHATLEY, J., Concur.
