Enclosed please find the order which the Honorable Court of Appeals has issued in reference to the above styled and numbered cause.

On February 29, 2024, the court reporter notified this court that the reporter's record was not filed because appellant failed to pay or make arrangements to pay the fees for preparing the record.

We ordered that appellant provide written proof to this court on or before March 1, 2024, that either (1) the fee had been paid or arrangements had been made to pay the fee, or (2) appellant is entitled to appeal without paying the reporter's fee. We advised appellant of the consequences if he failed to respond within the time provided. See Tex. R. App. P. 37.3(c).

On March 4, 2024, appellant responded to our order and the trial court clerk's record contains his statement of inability to afford payment of court cost or an appeal bond. Accordingly, the court reporter is ORDERED to file the reporter's record no later than April 5, 2024.

If the court reporter intends to object to appellant's statement of inability to afford payment of court cost or an appeal bond, any such motion must be filed no later than March 18, 2024. See Tex. R. Civ. P. 145(e)(1).
