This case for the redetermination of a deficiency, presently set for trial during the Los Angeles, California, trial session scheduled to begin in that city on October 7, 2024, is before the Court on respondent's Motion to Dismiss for Lack of Prosecution, filed August 30, 2024.

Giving due regard to the representations contained in that motion, it is

ORDERED that respondent's motion is set for hearing at the time, date and place shown in the Notice Setting Case for Trial, served May 7, 2024.

Petitioner is advised that the failure to attend the hearing could result in the entry of decision as requested in respondent's motion.
